THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1450 of 2017 ORDER:
This Contempt Case is filed alleging violation of order, dated 27.03.2017, passed by this Court in Writ Petition No.10781 of 2017.
By the aforesaid order, this Court disposed of the Writ Petition with the direction to the third and fourth respondents therein to consider the complaints of the petitioner, if they are true, and take necessary action against the fifth respondent therein.
A counter-affidavit along with photographs has been filed by the respondents herein setting out the action taken by them with respect to the violations committed by the fifth respondent in the Writ Petition.
A reply affidavit is filed by the petitioner setting out in detail that though the respondents filed a counter-affidavit stating that action has already been taken, there are other deviations upon which the respondents have not taken any action and that the constructions made by the fifth respondent in the Writ Petition are causing obstruction to the passage of the petitioner, as such, there is a contempt on the part of the respondents.
Having considered the above and having gone through the material on record, it is not possible for this Court to supervise to what extent deviations have been removed and to come to a conclusion whether the fifth respondent in the Writ Petition is causing obstruction to the passage of the petitioner or not. Further, the order in the Writ Petition is limited to the extent of considering the complaint of the petitioner. Therefore, it can be said that there is no contempt on the part of the respondents in complying with the order of this Court.
Accordingly, the Contempt Case is closed, leaving it open to the petitioner to workout the remedies including approaching appropriate forum seeking appropriate relief. Miscellaneous Petitions, if any pending shall stand dismissed.
