O R D E R
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.7 in FIR No.1930 of 2025 of Miyapur Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 143(5), 61(2), 111 of the BNS and Sections 80, 81, 87 of the JJ Act.

The case of the prosecution is that, on 24.12.2025, the de-facto complainant lodged a report before the police stating that, on 23.12.2025, while the petitioner was present in Police Station, he received credible information that some persons are gathering at Metro Pillar No.600 to sell infant baby who was taken at Ahmadabad and to earn huge monetary gains. Believing the information received to be true and authentic, he informed the same to superior officers, he secured the presence of two mediators and he along with panchas and staff rushed to the spot and they halted with a distance of 100 meters, and initially he sent Sri. Narsh, PC 5877 to Pillar No.
600 to confirm the information by giving a signal, accordingly the said PC confirmed the information to be true, upon which he along with staff and panchas proceeded to the spot and found three female and three male persons with infant baby aged about 10 days. He disclosed his identity and purpose of visit. On enquiry with the first person he disclosed his name and particulars as Vemula Babu Reddy i.e A.1 and all the accused formed into an organized gang with a common intention to illegally procure and sell infant babies for monetary gain. Hence, the complainant requested to take necessary action.

Heard Sri T. P. Acharya, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and she is in jail since 24.12.2025 and the only allegation against the petitioner herein is that she is also a mediator for selling the infant babies. It is further submitted that the material part of the investigation was already completed and there are no other cases pending against the petitioner herein and the custodial interrogation of the petitioner is also completed. Therefore, he prayed the Court to grant bail to her by allowing this criminal petition.

On other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner by filing counter and stating that it is a human trafficking of accused Nos.1 to 10 and there is not
- 4 - only one infant, but there are several infants sold by the group of people and it is an organized crime and till today, they are unable to tress out the biological parents of the infants of Ahmedabad, as such, she is not entitled for the bail and prayed the Court to dismiss the criminal petition. 6.
In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 25.12.2025 and as seen from the record, to an extent of the petitioner herein, custodial interrogation is also completed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned VIII
- 5 - Additional Judicial Magistrate of First Class, at Kukatpally, Cyberabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
