HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.7279 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a Writ, Order or Direction more particularly one in the Nature of Mandamus declaring the inaction of the 1st to 3rd respondents in application made by the petitioner on 08.02.2016 to release death benefits of her husband who worked as Support Man in the Organization of the 1st to 3rd respondents that died in an accident on 19.12.2015 as illegal, arbitrary, unjust, unlawful, unconstitutional and against to the Article 14, 16, 19, 21 and 300-A of the Constitution of India and also against to catena of Judgments of this Hon'ble Court."
2. Heard Sri Chikkudu Prabkakar, learned counsel for the petitioner and Sri J. Srinivasa Rao, learned Standing Counsel for respondents 1 to 3.
3. When the matter is called, it is submitted by the learned Standing Counsel for respondents 1 to 3 that a rival claim made by the 4th respondent is pending, as such, the death benefits could not be realised.
4. Having regard to the nature of controversy, this Court deems it appropriate to dispose of the writ petition by directing the respondents herein to take appropriate action on the application, dated 08.02.2016, said to have been made by the petitioner after hearing the petitioner as well as the 4th respondent.
5. For the aforesaid reasons, the Writ Petition is disposed of directing the Manager RH-ALP Mine, Godavarikhani, Karimnagar District, Telangana State (2nd respondent) to take appropriate action on the representation, dated 08.02.2016, said to have been submitted by the petitioner after hearing the claims of both the petitioner as well
as the 4th respondent within a period of eight (8) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
