HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.3137 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and Sri Balaji.N, learned Standing Counsel for respondent Nos.2 to 4, before ordering notice to the unofficial respondent No.5, and perused the prayer in the writ petition with supporting affidavit, photos and other material on record.

The prayer in the writ petition reads as follows: ".......to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in trying to dispossess the Petitioner from the toilet complexes vide Annexure-A to this Writ Petition being built and managed by the Petitioner under BOT as illegal, arbitrary, unlawful, unconstitutional, and in violation of principles of natural justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

It is the averment in support of the prayer from the affidavit that the respondents are trying to interfere including through respondent No.5. Whereas, the learned Standing Counsel, who stated from oral instructions, that there is no basis in that allegation and they are not interfering and if at all they want to interfere, they follow due process of law.

By recording the same, the writ petition is disposed of.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
