HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13728 of 2003 ORDER:
This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.2 of 2000 on the file of the 1st respondent and quash the award dated 06.02.2002 passed therein holding it as illegal and arbitrary. A consequential direction is also sought to reinstate the petitioner into service with continuity of service and back wages.
When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner had attained the age of superannuation during pendency of the writ petition. He, however, contends that the service benefits of the petitioner for the services rendered prior to his removal may be paid to the petitioner in accordance with the Regulations.
Having considered the submission made by the learned counsel for the petitioner and perused the record, I am of the view that the writ petition can be disposed of with a direction to the respondents to pay the service benefits of the petitioner.
Accordingly, the writ petition is disposed of directing the respondents to pay the service benefits of the petitioner for the services rendered prior to his removal, in accordance with the
Regulations, if not already paid, within a period of four (4) weeks from the date of receipt of a copy of this order.
