HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9122 of 2017 ORDER:

Heard the learned counsel for the petitioner/ accused and learned Public Prosecutor representing respondents 1 to 4 before ordering notice to the 5th respondent and perused the grounds urged in the petition and other material on record. Undisputedly, petitioner made a representation even to the Superintendent of Police, Wanaparthy, for cancellation of Lookout notice in relation to passport bearing No.L3489080. The said Lookout notice was issued from that representation and also from the submission by the learned Public Prosecutor in relation to Crime No.106 of 2014 registered against the petitioner on the report of the 5th respondent, wife of petitioner, by also showing his parents and brother as other accused for the offences punishable under Sections 406 and 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act.

The police after investigation filed final report. The learned Judicial Magistrate of First Class, Atmakur, taken cognizance for the said offences and allowed C.C.No.283 of 2015 and after framing of charges and after contest, by full dressed trial, the said case re-numbered as C.C.No.33 of 2017 was disposed of by learned Judicial First Class Magistrate (Mobile Court), Mahabubnagar, by acquittal judgment dated 06.09.2017.

Dr.SSRB,J Lookout notice, same is not responded and because of the same, he is unable to obtain travel permit to go abroad to resume his job there. There is nothing even of his requirement in any other crime not to recall the Lookout notice, that too, it was issued in above case, that was when ended in acquittal from perusal of the acquittal judgment referred supra.

Having regard to the above, the Lookout notice is forthwith cancelled by directing the Authorities concerned to permit the petitioner to pursue with his travel permit from otherwise entitled.
