HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.27085 of 2005 ORDER:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner.

Petitioner-college, in the instant writ petition, seeks the following prayer:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to declare rule 5 of the laws of Sri Venkateswara University comprised in Chapter - XI relating to Affiliation and Recognition of colleges as not valid in the light of the judgment of Supreme Court in T.M.A. Pai Foundation case, reported in 2002 (8) SCC 481 and also in the light of Sections 24 and 25 of the A.P. Education Act, 1982 by issuing writ of mandamus or any other appropriate writ or order as this Hon'ble Court deems fit and proper."

Learned counsel for the petitioner does not press the writ petition on merits, and seeks liberty to the petitioner to raise similar challenge, as raised in the present writ petition, if the circumstances so demand. The writ petition is disposed of as not pressed with liberty as prayed.

Consequently, pending miscellaneous applications shall also stand closed. No costs.
