HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20936 OF 2008 ORDER:

The petitioner challenges proceedings of the Collector, Guntur in Rc.No.1010/05C4 dated 16-5-2008 filed appeal before the first respondent under Section 7 of Act 16 of 1993. The first respondent through the memo impugned in the writ petition rejected the prayer of petitioner for grant of stay of operation of proceedings dated 16-5-2008. Hence, the writ petition.

On 24-9-2008, this court granted interim suspension of proceedings dated 16-5-2008. The counsel appearing for petitioner submits that the appeal No.5964/CV.2/2008-1 is still pending with the first respondent and while continuing to maintain the interim order dated 24-9-2008, which was made absolute on 4-6-2013 requests the court to direct the first respondent to pass final orders in the appeal pending in Case No.5964/CV.2/2008-1 within reasonable time.

The Assistant Government Pleader does not oppose the request. Having regard to the above circumstances, the writ petition is ordered as follows:

The interim order dated 24-9-2008, as made absolute on 4-6-2013 is made the final order in the writ petition. The first respondent is directed to dispose of the appeal expeditiously, preferably within three months from the date of receipt of copy of this order.

As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. ________________ JUSTICE S.V.BHATT Dated 7-3-2017.
