THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.229 of 2018 ORDER :

This Contempt Case is filed alleging willful disobedience of the order dt.02.01.2018 passed in WP.No.43753 of 2017, whereunder this Court directed the Tahsildar, Gudur Mandal, Mahabubabad District to consider grant of 'No Objection Certificate' to petitioner in respect of the subject land.

Initially, an order was passed on 03.02.2018 by the respondent herein, referring to pendency of some Writ Petition in this Court, as an impediment to consider the request of the petitioner. So, the Court issued Notice in Form-I. Thereafter, the respondent appeared in person before this Court on 07.08.2018, and time was sought. In the meantime, order dt.08.08.2018 has been passed by the respondent superseding the earlier order dt.03.02.2018, rejecting petitioner's request for grant of 'No Objection Certificate'. 3.

Though the counsel for petitioner sought to contend that the said order is not legally valid, such issue cannot be gone into in the present Contempt Case.

Therefore, the Contempt Case is closed, granting liberty to the petitioner to assail the order dt.08.08.2018, passed by 3rd respondent in a separate Writ Petition. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Contempt Case, shall stand closed.
