M/S Padigela Rajeshwar Ginning Industries, v. Telangana North Power Distribution Company
THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.23891 of 2015 ORDER:
The first petitioner is a partnership firm and is doing business of ginning and pressing of cotton. It obtained HT service connection from the respondentTelangana State Northern Power Distribution Company Limited (TSNPDCL), vide connection bearing No.ADB-240. The first petitioner received electricity bill for the month of March, 2015 showing the arrears of Rs.4,45,831/- and the running month bill of Rs.2,76,373/- totaling Rs.7,22,204/-. Later on, a revised bill was issued. However, the first petitioner received a letter dated 13.03.2015 from the fifth respondent-Senior Accounts Officer, TSNPDCL, Operation Circle, Adilabad, stating that an amount of Rs.13,29,896/- is outstanding towards arrears of CC charges as on that date and it was contrary to the revised bill dated 26.02.2015. The first petitioner submitted a representation dated 20.
03.2015 and the same was not considered. Later on, the first petitioner was issued a letter dated 23.04.2015 stating that the CC bill for the month of February, 2015 is revised as per the report of the fourth respondent and it was requested to pay an amount of Rs.9,73,736/-. Thereafter, in order to avoid disconnection, the petitioner has paid an amount of Rs.7,22,204/- towards electricity bills for the month of February and March, 2015, to that effect, the petitioner addressed a letter dated 05.05.2015 to the fifth respondent with regard to said payment. After receiving the same, the second respondent issued a letter dated 14.05.2015 to the petitioners directing to pay an amount of Rs.5,16,466/- to avoid disconnection of power supply. Challenging the same, the present writ petition is filed.
The learned standing counsel for the respondent-TSNPDCL submits that since the dispute is with regard to the electricity bill, the petitioner can as well go before the Ombudsman and seek resolution to the dispute, but the learned counsel for the petitioners submits that there is a threat of disconnection. In the circumstances, the petitioners are given liberty to approach the competent authority and obtain appropriate proceedings for resolution of the dispute, within a period of one week from the date of receipt of a copy of this order and the respondents shall not disconnect the power supply for a period of 10 days from
today.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 03.08.2015 Note: Issue CC in two days.
