THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.11244 OF 2015 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.112 of 2011 on the file of the XVI Special Magistrate at Erramanzil, Hyderabad.

Learned counsel for the petitioner/accused seeks permission of this Court to permit the petitioner to withdraw the petition with a liberty to avail the remedies available under law including filing of petition under Section 70(2) Cr.P.C. to recall the nonbailable warrant issued against him. Permission is accorded.

The Criminal Petition is dismissed a withdrawn with liberty as sought for. Learned XVI Special Magistrate at Erramanzil, Hyderabad, is hereby directed to dispose of the application to be filed by the petitioner under Section 70(2) Cr.P.C. in accordance with law on the same day. Miscellaneous petitions, if any, pending shall stand dismissed.
