SMT JUSTICE T. RAJANI CRIMINAL PETITION No.1122 of 2018 ORDER:

This petition is filed under Sections 437 and 439 of Cr.P.C., seeking to grant bail to the petitioners, who are A8 and A9, in NDPS SC No.58 of 2017 on the file of Special Judge for Trial of Cases under NDPS Act-cum-I Additional District Judge, Vizianagaram, registered for the offences under Section 8 (c) read with Section 20(b)(ii) of NDPS Act.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The counsel for petitioners submits that in total, 792.865 Kgs of ganja was seized from the vehicles and that the petitioners were allegedly travelling in the car of A1 containing 600 Kgs of ganja. Hence, the quantity of ganja involved in the case is commercial and therefore, Section 37 of NDPS Act does not permit the Court to grant bail to petitioners.
