THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.25688 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action of the respondents in not extending the installments facility to the petitioner for payment of July, 2016 Current Consumption Bill in terms of representation, dated 24-07-2016 of the petitioner as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the learned standing counsel for the respondents.

3. As can be seen from the affidavit averments of the petitioner, petitioner-company is having HT SC No.390/ONG for which demand has been raised by the respondents for a sum of Rs.66,07,210/- towards consumption charges for the month of July, 2016.

4. Learned counsel for the petitioner submitted that the petitioner is ready and willing to pay an amount of Rs.20,00,000/- on or before 05-08-2016 and the remaining balance amount in four monthly installments.

5. Both counsel with one voice submitted that this Court in W.P.No.17341 of 2016 granted installments for payment of due amount to the respondents.

6. Having regard to the facts and circumstances of the case, the petitioner is hereby directed to pay an amount of Rs.20,00,000/- to the respondents on or before 05-08-2016 and remaining balance amount i.e., Rs.46,07,210/- in four installments i.e., Rs.11,57,210/-, Rs.11,50,000/-, Rs.11,50,000/- and Rs.11,50,000/- on or before 5th of every month commencing from September, 2016. The respondents are entitled to collect interest at the rate of 18% per annum on the above said amount. If the petitioner fails to pay any one of the installments, the respondents are at liberty to take coercive steps.

7. Accordingly, the Writ Petition is disposed of. No order

as to costs. Miscellaneous petitions, if any pending, in this writ petition shall stand closed.
