THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23857 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order writ or direction more particularly in the nature of a writ of mandamus declaring the action of the respondents No.2 and 3 in not taking any action on the illegal constructions being made by the 4th respondent in contravention of sanctioned plan in BA No. 29/2016/G3 dated 3.3.2016 by encroaching the public road is illegal, arbitrary and is in violation of Greater Hyderabad Municipal Corporation Act, 1955 and consequently direct the respondents to remove the illegal constructions being made by the 4th respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

After arguing for sometime, learned counsel for the petitioners requested the Court to direct respondent Nos.2 and 3 herein to consider the legal notices, dated 27.06.2017 and 06.07.2017, of the petitioners and take appropriate action against respondent No.4 in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioners, without going into the merits of the case, respondent Nos.2 and 3 are hereby directed to consider the legal notices, dated 27.06.2017 and 06.07.2017, of the petitioners and take appropriate action in accordance with law regarding the

illegal construction alleged to have been made by respondent No.4 as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
