AND The State of Telangana, Through PS, Boath, Adilabad District Rep. by its Public Prosecutor, High Court of Judicature of Telangana at Hyderabad Res po nde nt/ Com p la ina nt Petition under Section 438 of Cr.P.C. praying. that in the circumstances stated in the petition filed herein, the High Court may be pleased to direct the SHO, PS, Boath, Adilabad District or Any other arresting'officer to enlarge the petitio ners/a ccu sed No.3 and 4 on bail in the event of their arrest in connection with Crime No. 72 of 2018 of the Police, PS Boath, Adilabad District. The petition coming on for hearing/ upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Srl S SURENDER REDDY Advocate for the Petitioners, and of Additional Public Prosecutor for the respondent, the Court made the following.
ORDER
I The petitioners are A.3 an| a.+ in Crime No.72 of 2018, registered on the file of Boath Police Station, Adilabad District, under sections 498-A and 3O4-B rlw Section 34 of IPC.
The petitioners/A.3 and A.4 are the father and brother respectively of A.1, the husband of the deceased. The de-facto complainant, being the father of the deceased, alleged that his daughter was subjected to harassment in relation to dowry demands by her husband and his family members and ultimately committed suicide.
The learned Assistant Public Prosecutor for the State of Telangana would concede that A.1, A.2 and A.5 have already been enlarged on regular bail after their arrest.
Perusal of the complaint reflects that no specific overt acts are attributed to the petitioners / A.3 and A.4, except for general allegations to the effect that they also harassed the deceased in connection with dowry demands. That being so, this Court is of the opinion that the petitioners/A,3 and A.4 can be granted anticipatory bail on some conditions.
Criminal Petition No,1088 of 2019 is accordingly allowed. Petitioners/A.3 and A,4 shall be released on bail in the event of their arrest in Crime No,72 of 2018 on the file of Baath Police Station, Adillabad Disdrict, upon their furnishing personal bonds each for a sum of Rs.10,000/- (Rupees Ten Thousand only) and also furnishing two sureties each for a like sum to the satisfaction of the Station House Officer, Boath Police Station, Adilabad District. They shall present themselves for interrogation as and when required by the police and shall not offer any inducement, threat or promise to any person connected with the case.
