This Criminal Petition is filed by the Petitioner-A4 to quash the proceedings initiated against him in Crime No.432 of 2014 of Pattabhipuram Police Station, Guntur Urban, registered for the offences punishable under Sections 447, 448, 406, 420, 506, 120-B read with section 34 I.P.C. 156 (3) Cr.P.C. and Section 3(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. A private complaint was filed by the 2nd respondentcomplainant against the petitioner and four others alleging the aforesaid offences before the Court of the Judicial Magistrate of First Class, Guntur (Special Magistrate for Prohibition and Excise) and it was referred to the police for investigation and report. Thereafter, the police registered the complaint as a case in Crime No.
432 of 2014 under the aforesaid offences and took up investigation. The present petition has been filed for quashing of the same. Heard the learned Counsel appearing for the petitioner and the learned Public Prosecutor, representing the State. The allegations in the complaint prima facie reveal the commission of alleged offences by the petitioner along with other accused. This is a matter, which requires investigation by the police. Therefore, I see no grounds to interfere at this stage with the investigation of the case.
Having regard to the aforesaid facts and circumstances of the case, the Criminal Petition is disposed of with a direction to the Investigating Officer to proceed with the investigation expeditiously, however, he shall scrupulously follow the procedure as contemplated under Section 41A Cr.P.C before taking any coercive steps against the petitioner-A4.
Miscellaneous petitions, if any, pending shall stand closed.
