THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34407 of 2011 ORDER:
In the present writ petition, the grievance of the petitioner is obviously the inaction on the part of respondent No.2-Shamshabad Gram Panchayat in taking action on the representation said to have been made by him on 23.11.2011.
Heard Mr.M.V.Raja Raam, learned counsel for the petitioner and Mr.G.Narender Reddy, learned Standing Counsel for respondent No.2-Gram Panchayat.
In the affidavit filed in support of the writ petition, it is stated that respondent No.3 is raising constructions without any permission. In the representation said to have been made on 23.11.2011, except stating that respondent No.3 started building construction illegally, there is no averment that without permission of the Gram Panchayat, he started construction.
In view of the same, this Court deems it appropriate to dispose of the writ petition, permitting the petitioner to make a representation afresh to respondent No.2-Gram Panchayat for taking necessary action against the illegal and unauthorized constructions said to have been made by respondent No.3.
For the aforesaid reasons, the writ petition is disposed of keeping it open to the petitioner to make a fresh representation to respondent No.2-Gram Panchayat, within a period of one month
from the date of receipt of a copy of this order. If any such representation is made within the time so stipulated, the same shall be considered and appropriate action be taken in accordance with law, after giving opportunity to all the stakeholders. Consequently, Miscellaneous Petitions, if any pending in this writ petition shall stand disposed of. There shall be no order as to costs.
