ORDER

Challenging FIR No.9 of 2017 on the file of the 3rd respondent, the present writ petition is filed.

Learned Government Pleader, on written instructions, submits that when the police were discharging their duties at the request of Sarpanch of Bitchkunda in removing the encroachments, a quarrel took place and in that connection, Cr.No.9 of 2017 was registered against two accused for obstruction to their duties. However, during the course of investigation, it is established that the petitioners, who are A1 and A2 along with A3-Kishan Gopal, have committed the offence and they are absconding since then.

Learned counsel appearing for the petitioners submits that the petitioners surrendered before the criminal Court and obtained bail. Since the matter is under investigation, this Court is not inclined to interfere with the same. But, it is needless to observe that while investigating the crime, the police shall follow due process of law. Accordingly, the Writ Petition is closed.
