HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12007 of 2015 ORDER:

This petition is filed by the petitioners - accused Nos.7 & 8 under Sections 437 & 439 Cr.P.C., seeking to grant bail in Crime No.367 of 2015 on the file of IIITown (L&O) Police Station, Rajahmundry, East Godavari District, registered for the offences punishable under Sections 366(A), 370, 370(A), 372, 373, 376(D) IPC and Section 6 of POCSO Act and Sections 5 & 6 of Immoral Traffic (Prevention) Act, 1056 r/w.34 IPC.

Heard and perused the material available on record. On 11.08.2015 at 3.30 p.m., the de facto complainant lodged a complainant before III-Town (L&O) Police, Rajahmundry stating that her daughter, aged about 14 years, went outside to get tiffin at 8.00 a.m. on that day, and she did not return home and though they searched for her in the surroundings areas, they could not trace out h e r. Basing on the said complaint, police registered a case and took up investigation. During the course of investigation, the missing girl was traced out on 19.09.2015. The statement of the victim girl was recorded by the police. The contents of the statement of the victim girl, about the involvement of the petitioners in the offences, are as follows:

"On 11.08.2015 at about 8.00 p.m., when the victim girl reached near Panasachettu center, the accused A1: Vasu, A2: Prem, A3, Gopi, A4: Shabbir, Auto driver forcibly kidnapped and put into their auto and took her to A1 house situated at Chowdeswarnagar, Rajahmundry and kept her in a room. In that room already two girls by name Siresha and Neelima are there at A1 house. On 12-08-2015 at 7-00 AM A1 to A4 took the victim girl and both Neelima and Sireesha to Bhimavaram and sold them for the purpose of prostitution to A7: Chinni and A8: Santhamma, who is mother of Chinni who maintains brothel at Bhimavaram and took money from them, A7, A8 made forcibly conducted prostitution and seduced to illicit intercourse with others for money, with victim girl for 10 days at their house/brothel at Bhimavaram. On 23-08-2015 at A1 to A4 came to Bhimavaram and took her to Rajahmundry A1: Vasu House at Chowdeswara Nagar and they raped her on the night

without her will and consent, they also used condoms. On the next day A1 to A4 along with A5: Arya, A6: Pandi Babu took the victim girl to Kakinada and sold her to A9: Bhavani for the purpose of prostitution. A9 used her prostitution/illicit intercourse with others for 11 days."

In view of the above allegations, which are so serious in nature, this Court is not inclined to grant bail to petitioners.
