HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25605 of 2009 ORDER:

This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the inaction of the respondents in according necessary help and police protection to the petitioner to protect his possession over an extent of Acs.2.50 cents of land in Sy.No.216/ 13, situated at Chodabadava Lanks, h/ o.Maskapally, Gangavaram Mandal, Batlapalika village, East Godavari District.

The case of the petitioner is that the petitioner is in possession of Government land of an extent of Acs.2.50 cents in Sy.No.216/ 13 on lease basis and he is cultivating commercial crops. While so, the respondents 3 and 4 are trying to encroach the said lands and the petitioner filed a suit for permanent injunction and the said suit was decreed in favour of the petitioner.

Heard and perused the material available on record. On 10.12.2009, while ordering notice before admission in the writ petition, this Court passed an interim order directing the respondent Nos.1 and 2 to extend necessary police protection to the petitioner in view of the decree passed in favour of the petitioner in O.S No.292 of 2008 on the file of the Principal Junior Civil Judge, Ramachandrapuram. Considering the facts and circumstances of the case, the interim order passed by this Court on 10.12.2009 in the writ petition is made absolute and respondent Nos.1 and 2 are directed to provide police

protection to the petitioner whenever the petitioner approaches them for providing police protection.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
