THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NOs.11226, 11227, 11234, 11235, 11238, 11279, 11282, 11289, 11712, 11719 and 11720 OF 2015 COMMON ORDER :

Since the subject matter of these writ petitions is one and the same, they are heard together and disposed of by common order. These writ petitions are filed for a Writ of Mandamus declaring the action of the respondents 1 and 2 in not considering the petitioners' representation dated 18.08.2014, as illegal and arbitrary and for a consequential direction to the 1st respondent to update the records to keep open the shop on all 365 days of the year vide G.O.Rt.No.663 dated 23.07.2013. The case of the petitioners is that they have been doing business after obtaining license under Section 7, 12 and 31 of APSE Act, 1988 to keep open the shops on all 365 days of the year from "Labour Employment Training and Factories" (LAB: IV Department) vide G.O.Rt.No.663 dated 23.07.2013 for a period of two years.

With regard to the same, petitioners made a representation dated 18.08.2014 to the 1st respondent intimating that they have obtained license to run the shops on all 365 days of the year and further requested to update the records that may be necessary for discharging of official obligations. But the respondent authorities instead of updating the records filed a false complaint against the petitioners. Aggrieved by the same, the present writ petitions are filed.

Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Labour submits that since the petitioners have violated condition No.7 of G.O.Rt.No.663 dated 27.03.2013, the case has been registered against the petitioners in STC 401 of 2015. When the matter is taken up for hearing, the learned counsel for the petitioners has not pressed for other relief in the prayer expect for disposal of the representation dated 18.08.2014.

Learned Government Pleader for Labour submits that the records have already been updated and states that the writ petitions are filed only on apprehension.

In view of the above submission, the 2nd respondent is directed to consider the representation of the petitioners dated 18.08.2014 filed for updating of the records, if not already done. With the above direction, these writ petitions are disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in these writ petitions, shall stand closed.
