THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.4042 OF 2019 ORDER:

Learned counsel for the petitioners as well as the learned Government Pleader appearing for the respondents submit that the issue raised in this writ petition is squarely covered by the order of this Court in W.P.No.20726 of 2010 dated 29.12.2016. However, learned Government Pleader appearing for the respondents submits that let the petitioners submit a fresh representation to the respondents and, upon such representation being received, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the aforesaid submissions, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a fresh representation to the respondents, staking their claim for regularization of their services, within a period of two weeks from the date of receipt of a copy of this order and, upon such a representation being received, the respondents are directed to consider the claim of the petitioners for regularization of their services in view of the law laid down by the Honourable Supreme Court in Secretary, State of Karnataka and Others v. Umadevi1 and pass appropriate orders in accordance with law, within a period of eight weeks thereafter.

1 (2006) 4 SCC 1

Accordingly, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. ______________________________ ABHINAND KUMAR SHAVILI, J 11th July, 2019 v v
