HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.35272 of 2012 ORDER:
This writ petition is filed seeking the following prayer: "to issue an appropriate writ, order or direction, more particularly one in the nature of a writ of Mandamus, to declare in inaction of respondent No.1 in considering the representation dt.23.8.2012 submitted by the petitioners for releasing the amounts for the purpose of digging wells under the Swarna Jayanthi Gram Swarajgari Yojana(SGSY) inspite of repeated visits as being illegal, arbitrary and unjust and consequently direct the respondents to release the said amounts to the petitioners, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."
The case of the petitioners is that they are agriculturists belonging to economically backward persons and in order to utilize the benefits under Swarna Jayanthi Gram Swarajgari Yojana(SGSY) framed by the Government, they have applied for sanction of financial assistance for digging a bore well for water; that their applications were forwarded through the 3rd respondent to the 1st respondent; that the officials of the Ground Water Department (Geologists) inspected their lands and submitted a report regarding availability of water and also feasibility for excavation of bore wells; that the petitioners approached the 1st respondent on several occasions requesting him to release the amount along with subsidy; that the petitioners also came to know that the respondent authorities have sanctioned the requisite amount but the amounts were not released as such the same was brought to the notice of the 1st respondent; that the 1st respondent vide his letter dated 30.06.2000 directed the 2nd respondent to
take appropriate action but in vain; the petitioners filed representations on 18.10.2003, 17.11.2003 and 23.08.2012 but no action has been taken. Hence, the writ petition.
Heard.
It is for the concerned authorities to take decision on the representations of the petitioners regarding release of the benefits under Swarna Jayanthi Gram Swarajgari Yojana(SGSY), when the same is in existence and more over no Mandamus can be issued by this Court for release of the amounts. But, if the said scheme is in existence and the petitioners are eligible for the same, the respondent-authorities has to be considered applications of the petitioners.
In view of the same, the 1st respondent is directed to dispose of the representation dated 23.8.2012 submitted to the 1st respondent in accordance with law, within four weeks from the date of receipt of a copy of this order. No costs.
