No representation for petitioner.

The writ prayer reads as follows :- " .... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent herein in not removing the hawkers in front of the Sulabha Toilets pursuant to the endorsement of the District Collector, Kadpa dt.01.04.2013 as illegal, arbitrary and consequently direct the 2nd respondent to forthwith take action pursuant to the endorsement dated 01.04.2013 ....." The 2nd respondent filed counter affidavit and paragraph '5' refers to removing the encroachments in front of public toilet facility run by petitioner.

Paragraph '5' reads as follows:- " It is humbly and respectfully submitted that as per the endorsement of the Collector, YSR District, this respondent issued necessary notices on 2.4.2013 to the hawkers/ petty business people who are doing the business in front of the sulabh toilets being maintained by the petitioner instructing them to vacate their business as they are causing obstructions to use the toilets of the petitioner. Subsequently, in due obedience to the interim directions of this Hon'ble Court, this respondent evicted the hawkers/ petty business people who are causing disturbance to the way to use the sulabh toilets of the petitioner. Photographs to that effect are filed herewith

along with this counter affidavit for the kind perusal of this Hon'ble Court. It is humbly submitted that this respondent has complied with the directions passed by this Hon'ble Court in letter and spirit. The further allegations made in the affidavit are false and hence the same are denied." By placing on record the stand taken by 2nd respondent, the writ petition is disposed of accordingly, as no further order is necessary.

Miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
