THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION Nos.26891 and 27292 of 2017 COMMON ORDER:

Since these two writ petitions are interlinked, this Court deems it appropriate to dispose of the same by way of this common order.

Heard Sri N.V.R. Amarnath and Sri A. Jagannadha Rao, learned counsel for the petitioners in W.P.No.26891 and 27292 of 2017 respectively and the learned Government Pleader for the respondents in both the matters.

In W.P.No.26891 of 2017, the petitioner, who claims to be a resident of the locality, prays for a direction to the respondents not to grant permission to the bar and restaurant without considering the representation, dated 07.08.2017, said to have been made by him.

In W.P.No.27292 of 2017, challenge is to the alleged action on the part of respondent Nos.3 to 5 in not permitting the petitioner to conduct the business in the premises bearing D.No.18-35-24/1, of Sangadigunta, Guntur.

According to the petitioner in W.P.No.26891 of 2017, he along with certain others made a representation on 07.08.2017, opposing the grant of licence.

Since it is evident from the material available on record that the Prohibition and Excise Superintendent, Guntur, already granted 2B licence in favour of the petitioner in W.P.No.27292 of 2017 on 15.07.2017, it is open to the petitioner in W.P.No.26891 of

2017 to file an appeal before the Deputy Commissioner of Prohibition and Excise, Guntur, in accordance with the provisions of Section 63 of the A.P. Excise Act, if he is advised to do so. It is also made clear that so long as the licence granted in favour of the petitioner in W.P.No.27292 of 2017 is intact, he cannot be restrained from carrying on the business in terms of the licence granted to him.

With the above observations, both the writ petitions stand disposed of. No order as to costs.
