HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3801 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ...... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus directing the respondents 1 to 3 to forthwith appoint the petitioner in any suitable post under the compassionate appointment in the place of her deceased mother namely Smt.Masani Yenkamma S/ o Chinna Nagappa Employee I.D.No. 1750564 who died in harness on 17.5.2017 ......" . Heard Ms.Nagavani Prassona, learned counsel for petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that her mother was appointed as a Sweeper with the respondents and while discharging her duties she expired on 17.05.2017. The grievance of petitioner is that she has submitted representation to the respondents on 01.06.2018 to consider her case for appointment on compassionate grounds. But, so far, the respondents have not considered the case of the petitioner nor passed any orders on the representation submitted by the petitioner.

Learned counsel for petitioner submits that appropriate orders be passed directing the respondents to consider the case of petitioner for appointment on compassionate grounds in accordance with Rules.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered in accordance with Rules and appropriate orders would be passed.

This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 01.06.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. ____________________________ ABHINAND KUMAR SHAVILI, J Date: 25-02-2019 Prv
