ORDER:
It is a matter of serious concern that respondent No.2-Corporation appears to be unperturbed at the alleged corruption of its own employees by turning a blind eye to an enquiry report stated to have been submitted to respondent No.3 as far back as 16.10.2009 in respect of the petitioner. If this enquiry report is to be accepted, the petitioner must be held guilty of misappropriating a sum of Rs.14.95 lakhs. Respondent Nos.2 and 3 seem to think that placing an employee under suspension and paying him subsistence allowance to the extent of 2/3rd of his salary will satisfy the public interest.
At the hearing, it has come out that though the enquiry had been pending for more than six years, recently, the petitioner has been paid the arrears of subsistence allowance.
The inaction on the part of respondent Nos.2 and 3 in finalizing the enquiry proceedings and passing a final order based on the enquiry report is some what shocking to this Court. Therefore, respondent No.3, who is stated to be the disciplinary authority, is directed to forthwith bestow his attention to the subject matter and ensure that an appropriate order based on the enquiry report is passed as per law after giving an opportunity of being heard to the petitioner.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.27148 of 2015 filed by the petitioner for interim relief is disposed of as infructuous.
