THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1156 OF 2018 ORDER:

This petition is filed by the petitioners-A2 to A4 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.194 of 2017 on the file of the Station House Officer, II Town Police Station, Proddatur, YSR Kadapa District, which was registered for the offences punishable under Sections 468, 471 and 420 IPC. 2.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that earlier crime was registered with similar allegations in Cr.No.208 of 2015 against the petitioners for the offences punishable under Sections 468, 471 and 420 IPC. The dispute between the parties is civil in nature. Again this crime is registered on a complaint filed by the same de facto complainant on reference made by the learned Magistrate under Section 156 (3) Cr.P.C. against the petitioners for the offences punishable under Sections 468, 471 and 420 IPC.

In view of submissions made and record placed before this Court, the Station House Officer concerned is directed not to arrest the petitioners-A2 to A4 in Cr.No.194 of 2017 and complete the investigation with regard to innocence, maintainability or otherwise of the subject proceedings.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
