18.07.2023 ML, J I.A.No.1 of 2023 This application has been filed to relax the condition No.ii imposed against the petitioner/accused No.2 in bail order viz., "On such release, the petitioner/A.2 shall appear before the Station House Officer, Khammam I Town Police Station, Khammam District on every Saturday between 10.00 a.m., and 12.00 Noon till the trial is completed." vide order dated 10.03.2022 in Crl.P.No.963 of 2022.

The learned counsel for the petitioner has submitted that the petitioner had been regularly attending the police station as per the direction of this Court dated 10.03.2022. He further stated that the charge sheet has also been filed and therefore, the presence of the petitioner is not required. Further he submitted that continuously attending before the concerned police station causing trouble to the petitioner.

Learned Additional Public Prosecutor appearing for the respondent has stated that charge sheet has been filed and the case is at PRC stage.

Heard the learned counsel on either side and perused the material placed on record.

In view of the submissions made by both the learned counsel, considering the nature of offence, presence of petitioner before the concerned police station is unwarranted.

Accordingly, this application is allowed and the condition No.ii in Crl.P.No.963 of 2022 imposed by this Court, dated 10.03.2022 is relaxed.
