THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37113 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "To issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, declaring that the inaction on the part of the Respondents 1 to 4 in not conducting the enquiry and taking further action in Crime No.312/2014, dated 29.10.2014 as illegal, arbitrary, contrary to law, and consequently to direct the Respondents 1 to 4 to submit a report before the Hon'ble Criminal Court as per the provisions of Chapter XII of Cr.P.C., and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. The petitioner is admittedly shown as an accused in Crime No.312 of 2014 on the file of Eluru II Town Police Station, West Godavari District.

3. Written instructions dated 17.03.2015 were furnished by the Inspector of Police, Eluru II Town Police Station, West Godavari District, stating that upon the complaint made by one Korada Balakrishna, Crime No.312 of 2014 had been registered under Sections 447 and 506 IPC on the file of Eluru II Town Police Station.

The Inspector further stated that after completion of the investigation a charge sheet was laid before the learned II Additional Judicial Magistrate of First Class vide S.R.No.1237 of 2016.

4. In the light of the afore-stated development, the prayer of the petitioner stands answered.

The Writ Petition is accordingly dismissed. Pending
