This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, seeking to quash the proceedings in Crime No.356 of 2017 on the file of the Kurnool II Town Police Station, Kurnool District, registered for the offences under Sections 509 of I.P.C. & Sections 3(1)(r)(s), 3(2)(Va) of SCs & STs (POA) Amendment Act, 2015. 2 .

Heard the learned counsel for the petitioner/ accused, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The learned counsel for the petitioner/ accused would submit that the petitioner/ accused is a stranger to the de-facto complainant, who is shown as accused No.1 in the report lodged on 26.10.2017.

The alleged offences are punishable with imprisonment less than seven years and ultimately prayed to allow the application.

Having regard to the submissions made by the learned counsel for the petitioner/ accused, the Station House Officer, Kurnool II Town Police Station, Kurnool District, is directed to follow the procedure laid down under Section 41A of Cr.P.C. and adhere to the guidelines formulated by the Apex Court in Ar n esh Ku m ar Vs. St at e of Bih ar 1.

With the above direction, this Criminal Petition is disposed of. 1 (2014) 8 SCC 273

- 2 - Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
