THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No.15920 of 2003 ORDER:
When the matter is taken up for hearing, it is noticed that the petitioner is challenging the orders of removal dated 19.04.2003 passed by the disciplinary authority, and is seeking the relief of reinstatement into service. A perusal of the record discloses that the petitioner has already attained the age of superannuation.

The learned counsel for the petitioner submits that the petitioner has expired recently, and contends that appropriate orders be passed, directing the respondents to pay the service benefits of the petitioner for the service rendered by him prior to removal from service, to the legal representatives of the petitioner.

This Court, having considered the said submission, is of the considered view that this writ petition can be disposed of directing the respondents to pay the service benefits of the petitioner for the service rendered by him prior to removal from service, to the legal representatives of the deceased petitioner, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. 4.
