This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri P SREE RAIMYA, Advocate for the Petitioner and Sri Syed Yasar fi/lamoon the Addl. THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.1879 of 2o25 ORDER:
This criminal petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'the BNSSJ seeking to quash the order dated O9.1O.2024, passed in Cr1.M.P.No.347 of 2024 irt Crime No.365 of 2024 by the learned Principal Sessions Judge at Hanumakonda. By the impugned order, the trial Court dismissed the petition filed to relax the condition imposed against the petitioner while granting anticipatory bail in Crl.M.P.No.232 ol 2024. 2.
Heard Ms. P.Sree Ramya, learned counsel for petitioners and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the State and perused the record. 3.
Learned counsel for petitioner/accused No.2 submitted that the petitioner was granted anticipatory baii on 23.07.2024. in Crl.M.P.No.232 of 2024 and from the date of the said order, the petitioner was regularly attending before the Station House Officer, Subedari Police Station, on every saturday. She further submitted that till today charge sheet is not fi1ed. Hence, he sought for relaxation of the said { condition.

On the other hand, learned Additional Public Prosecutor submitted that the petitioner is attending before the Station House Officer, Subedari Police Station, regularly and the trial Court dismissed the Cr1.P.No.347 of 2024 only on tle ground that accused Nos.3 to 35 are yet to be apprehended and the investigation is not completed.

In view of the submissions made by both the parties, since the petitioner/accused No.2 attending before the Station House Officer, Subedari Police Station, regularly from July, 2024, thrs Court of the considered view that it is a ht case to relax the said condition.

Aicordingly, this petition is disposed of and condition imposed in the order dated 23.07.2024 passed by the trial Court, in Cr1.M.P.No.232 of 2024 in Crime No.365 of 2024, is hereby relaxed only to the extent of the petitioner attending before the Station House Officer, Subedari Police Station. However, the petitioner is directed to appear before the Investigating Oflicer whenever his presence is required. Misceilaneous applications, if any pending, shall stand closed.
