This writ petition is filed seeking to issue a writ of mandamus declaring the Award dated 10.7.2007 in File No.F/1719/2003, passed by the Land Acquisition Officer-cum-Revenue Divisional Officer-2nd respondent herein, as illegal and void, and consequently, to direct the 2nd respondent to pay the compensation amount of Rs.53.26 lakhs to the petitioner as determined and fixed by him and deposited by respondents No.3 and 4 in this Court with interest at the rate of 12% p.a., from 12.10.2004 till the amount is paid to the petitioner.

Heard Sri K. Raghuveer Reddy, learned Counsel for the petitioner and the learned Government Pleader for Land Acquisition. 3.

When this matter was taken up for hearing, the learned Government Pleader for Land Acquisition, based on the records available and on the instructions of the Deputy Tahsildar attached to the office of the Revenue Divisional Officer, Mahabubnagar, informed that the amount indicated in the Award Dated 10.7.2007 needs to be modified to that of Rs.53.26 lakhs instead of Rs.3,19,770/-.

The learned Counsel for the petitioner stated that the petitioner has no objection if the amount in the Award dated 10.7.2007 is modified to that of Rs.53.26 lakhs to be paid to the petitioner along with interest at the rate of 12% p.a., thereon.

The learned Government Pleader further informed that the amount of Rs.53.26 lakhs has already been kept in Revenue Deposit and whatever

the interest accrued on such deposit should be paid to the petitioner and therefore, no further interest needs to be paid to the petitioner. 6.

In view of the above submissions, the amount of Rs.3,19,770/- mentioned in the Award dated 10.7.2007 is modified to that of Rs.53.26 lakhs. The modified amount shall be paid to the petitioner within a period of eight weeks from the date of receipt of a copy of this order. Since the amount has already in deposit, the interest accrued thereon shall be paid to the petitioner. No further interest is hereby awarded. 7.

With the above observations, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
