THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No. 377 of 2017 ORDER:

This contempt case is filed alleging non-implementation of the order, dated 29.04.2016, passed in W.P.No.31273 of 2011. A counter-affidavit is filed enclosing a copy of the Memo, dated 13.07.2017, issued by the Government rejecting the request of the petitioner for admission of un-aided posts into grant-in-aid.

After perusing the said Memo, learned counsel for the petitioner submits that the same was issued without hearing the petitioner and if the petitioner is driven to another round of litigation, he would suffer.

Learned Government Pleader, on the other hand, submits that a decision was taken based on the enrolment and in view of the particulars available with the Department with regard to the enrolment of the candidates, it is not feasible to admit the posts into grant-in-aid.

Be that as it may, in order to give opportunity to the petitioner to represent its case, the Commissioner and Director of School Education, Velagapudi, Andhra Pradesh, shall hear the petitioner on 24.07.2017, on which date the petitioner shall be present with a written representation with regard to its case. After considering the objections, the Commissioner and Director of

School Education shall send appropriate recommendations to respondent No.1 in the writ petition for passing revised orders. In view of this arrangement, further proceedings in the contempt case are dropped.

The contempt case is accordingly closed.
