HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE M.GANGA RAO Writ Appeal Nos.211 of 2010 and 1028 of 2012 Common Judgment: (per V.Ramasubramanian, J.) These two writ appeals have been filed by the Distance Education Council of Indira Gandhi National Open University (IGNOU), New Delhi, challenging a common order passed by a learned single Judge of this Court in a batch of writ petitions.

2. In the batch of writ petitions, the learned single Judge passed an order to the effect that only such courses imparted by Deemed Universities through distance mode, as are approved under the letter jointly signed by Secretary, UGC, Member Secretary, AICTE and Director, DEC, shall be treated as valid and legal and that such of the petitioners who have studied the courses through distance mode from Institute of Advanced Studies in Education (IASE), Rajasthan, are not entitled to the conferment of the degrees.

3. After the filing of the writ appeals, two things have taken place. The first is that the Distance Education Council of IGNOU itself has been abolished in the year 2013. Therefore, the appellant in these two writ appeals is not in existence today.

4. The second development that has taken place is that the degrees awarded by IASE, Rajasthan and two other institutions, during the period from 2001 to 2005, have been

declared invalid by the Supreme Court in Orissa Lift Irrigation Corp. Ltd. v. Rabi Sankar Patro1. Therefore, the appellant which is not in existence today, cannot have anymore grievance against the judgment of the learned single Judge.

Hence, the two writ appeals are dismissed.

The miscellaneous petitions, if any, pending in these writ appeals shall stand closed. No costs.
