THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION Nos.20994, 26494 and 22578 of 2011 COMMON ORDER:
Since the petitioners in all the writ petitions share a common grievance, this Court deems it appropriate to pass common order in these writ petitions.
When the matter is called today, common order, dated 0807-2013 passed by this Court in writ petition Nos.18807 of 2008 and batch is placed on record by the learned counsel for the petitioners. The operative portion of the said order reads as under: "8. In my opinion, as long as the certificate granted to the petitioners by the competent authority under the Act stands and is not cancelled under Section 5 of the Act, they cannot be denied the benefits which flow from the said certificate. It is always open to the competent authority under the Act to take steps against petitioners by initiating steps to cancel the community certificate issued to them under Section 5 of the Act by following the principles of natural justice.
9. Therefore, giving liberty as aforesaid to the competent authority under the Andhra Pradesh (SC, ST & BC) Regulation of Issue of Community Certificates Act, 1993 to take appropriate steps, if so advised, for canceling the community certificates issued to the petitioners in these writ petitions, all the writ petitions are disposed of directing the respondents to give effect to them till they are cancelled in accordance with law. No costs."
Following the above said common order and for the reasons recorded therein, these writ petitions are also disposed of, in terms thereof.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
