THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15640 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Standing Counsel for second respondent.
The petitioner is a tenant of premises bearing No.7-3-112, Saraswati Nagar, Sagar Main Road, Bairamalguda, Ranga Reddy District. The tenancy commenced from 01-10-2011. The petitioner states that he deposited an amount of Rs.70,000/- towards security deposit and he has been paying monthly rents to the landlord. With regard to the enhancement of rent there is a dispute between the petitioner and the respondents 4 and 5. The petitioner filed O.S.No.34 of 2015 on the file of the Principal Junior Civil Judge, Ranga Reddy District at L.B.Nagar for Perpetual Injunction against the respondents 4 and 5 and filed I.A.No.51 of 2015 seeking interim injunction and infact the interim injunction was granted against the respondents 4 and 5. In respect of the premises, there are two service connections standing in the name of respondent No.5.
The petitioner is a tenant and has been paying monthly consumption charges promptly. It appears that respondent No.5 filed a letter before the respondent No.3 on 22-05-2015 for cancellation of service standing in the name of respondent No.5. On the basis of said letter, the electricity connection was disconnected on 23-05-2015. The relationship between the petitioner and the respondents 4 and 5 is in dispute and is pending consideration in O.S.No.34 of 2015 on the file of Principal Junior Civil Judge, Ranga Reddy District at L.B.Nagar. The respondents 1 to 3 are bound by the terms and conditions of the supply and so long as the tenant pays current consumption charges, they cannot disconnect the supply on the basis of letter of the owner.
3 to restore the power supply subject to condition of the petitioner paying monthly consumption charges regularly. If the terms and conditions of the supply permit the disconnection of supply at the instance of owner, the respondents 1 to 3 shall issue appropriate notice to the petitioner and after considering the explanation of the petitioner shall take necessary action. Till the petitioner pays the current consumption charges, the power supply to the petitioner shall not be disconnected.
The miscellaneous petitions pending, if any, in this writ petition shall stand closed. There shall be no order as to costs.
