THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.19815 OF 2000 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records connected with the impugned Lr.No.SSCUB/Staff/Frauds/992000, dated 29.2.2000 issued by the 1st respondent, whereunder the petitioner was dismissed, and to issue a consequential direction to the respondents to reinstate the petitioner.

Heard Sri D. Linga Rao, learned Counsel for the petitioner and the learned Government Pleader for co-operation.

It has been contended by the learned Counsel for the petitioner that the petitioner had not committed any fraud as alleged by the 1st respondent and that the 1st respondent dismissed the petitioner without conducting any enquiry, and therefore, the present writ petition is filed. 4.

It has been contended by the learned Counsel for the 1st respondent that the 1st respondent Bank has been under liquidation, and the liquidation proceedings has already been issued by the District Co-operative Officer, Hyderabad, on 25.6.2004 and that the liquidator was also appointed. 5.

The 1st respondent-Bank is a Co-operative Urban Bank registered under the A.P. Co-operative Societies Act. If any employee of the Cooperative Urban Bank is imposed any punishment of dismissal/removal, such employee has a remedy to approach the authorities concerned under the A.P. Shops and Establishments Act. But without exhausting such remedy available under the A.P. Shops and Establishments Act, the petitioner has straight away approached this Court by way of filing this writ petition. In view of the same and in view of the fact that the 1st

respondent Bank was wound up and the liquidator has already been appointed, this Court is not inclined to entertain this writ petition. 6.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. It is needless to say that the petitioner is at liberty to approach the authorities concerned and the liquidator, under the A.P. Shops and Establishments Act, to agitate his claim and contention that the 1st respondent-Bank is not justified in dismissing him from service.
