THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 40338 of 2012 ORDER:

This writ petition is filed challenging the action of the 4th respondent in registering FIR No.324 of 2012 for the offences punishable under Sections 448, 427, 509 and 506 IPC, against the petitioner.

2. Learned Government Pleader submits that a counter affidavit is filed by the Inspector of Police, II Town Police Station, Mahabubnagar District, stating that the 2nd respondent lodged a complaint on 18.12.2012 stating that he owned a house No.1-7-183/26/A situated at New Gunj, Mahabubnagar Town; the neighbour was interfering and trespassing into his part of land; that he damaged the basement which was under construction and abused his wife in filthy language. Based on the same a case in Crime No.324 of 2012 was registered.

3. The petitioner surrendered before the Court and was released on bail on 28.02.2013. A charge sheet was filed before the Court of the Judicial Magistrate of First Class, Mahabubnagar, on 15.03.2013 and the same was taken on file in C.C.No.271 of 2013.

4. Learned counsel for the petitioner submits that he

filed Crl.P.No.15068 of 2013 before this Court seeking quash of proceedings in C.C.No.271 of 2013 and this Court granted stay by order dated 18.12.2013. He also submits that a writ petition i.e., W.P.No.453 of 2013 was also filed and the same is pending.

5. In view of the subsequent developments, the present writ petition has become infructuous.

6. Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
