THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11149 of 2016 ORDER:
This criminal petition is filed to quash the proceedings in C.C.No.25 of 2015 under Section 34(a) of the A.P.Excise Act, 1968 on the file of Judicial First Class Magistrate, Pakala. Heard both sides.
Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned proceedings. However, it is open for the petitioners/accused to surrender before the Court below and file appropriate application within two weeks from today to recall the warrant. In such an event, the Court below shall dispose of the application of the petitioners on the same day on which it is filed on reasonable terms, in accordance with law. Till such application is filed, as stated above, the warrant should not be executed. The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
