HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20978 of 2011 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner to declare the action of the respondents in not investigating Crime No.384 of 2009 on the file of I-Town Police Station, Ongole, as illegal and arbitrary, and consequently, direct the respondents to investigate into the above said crime and file report expeditiously. Heard and perused the material available on record. The case of the petitioner is that on 10.09.2010, the petitioner filed a private complaint before the II-Additional Judicial Magistrate of First Class, Ongole against one Mallavarapu Koteswara rao, Mallavarapu Subbamma, Mareddy Govinda Reddy and Mareddy Venkata Subbamma and others for the offences under Sections 384, 420, 465, 468 and 469 r/ w.107, 34 IPC.
The said complaint was forwarded to the Station House Officer, I-Town Police Station, Ongole, for investigation into the matter and for filing of report, and the same was registered as Crime No.384 of 2009 by the Station House Officer, I-Town Police Station, Ongole. The grievance of the petitioner is that though the crime was registered, the police concerned are not investigating into the matter expeditiously. The 3rd respondent filed counter affidavit stating that the investigation in the said crime was completed and the final report is likely to be filed in accordance with law.
Recording the submission made by the 3rd respondent in the counter, the writ petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J August 04, 2017 KTL
