HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3875 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus directing respondent Nos.1 to 4 to consider the application of the petitioner dated 24.11.2018 and to pass appropriate orders forth and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the application dated 24.11.2018 made by the petitioner reflects that it is as vague as can be. The relevant portion of the application reads as under:

"I submit that there is an ambiguity for the bank and as well as me in respect to the classification of the land as plot under Record of Survey maintained by you and thus request your good office to provide the details of the record of Survey in respect to the property mentioned above. Further, kindly provide the details of the assignment of house sites in village particularly under the survey No.105/1 of the Record (B.S.O.21,34-A & 34-B) and in the event resurvey if required, I may kindly be informed enabling me to pay necessary fee conducting survey and oblige."

Learned Assistant Government Pleader for Revenue, State of Telangana, would point out that in the event the petitioner wants a survey to be undertaken, she would have to make an online application along with the requisite fee and relevant documentation. It is clear that the petitioner has not followed this due procedure and has made an ambiguous application which does not even indicate in clear terms as to what she wants. On the strength of such an application, it is not open to the petitioner to complain of inaction on the part of the revenue authorities.

SK, J WP.No.3875 of 2019 Dt:26.02.2019 The Writ Petition is accordingly disposed of leaving it open to the petitioner to make an application in the prescribed format along with the requisite fee and relevant documentation. In the event such an application is made, the Tahsildar, Malkajgiri Mandal, Medchal District, shall consider the same and take appropriate action thereon, as warranted, expeditiously and in any event, not later than eight weeks from the date of receipt of such application.
