HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2458 OF 2017 ORDER:
The case of the petitioner is that he is having land in Survey No.52/12, 52/14 and 50/12, situated at Gunjarlapalle Village, Shantipuram Mandal, Chittoor District and the said lands are ancestral properties by way of partition deed in the year 2007 and that the petitioner is in possession and enjoyment of the said lands since 2007. The petitioner also obtained pattadar pass books and title deeds, adangals, 1-B Register and is also paying taxes. While so, when the neighbouring land owners tried to encroach the said land, petitioner submitted application by paying an amount of Rs.285/- through AP Online by way of challan No.AD1057481, dated 24.06.2016 for conducting survey of the said land. In pursuance of the same, respondents 3 and 4 issued notices on 24.06.2016 and 29.07.2016 to the adjacent land owners. But, till today no further action is being taken for conducting survey and for fixation of boundary stones to the said land. Aggrieved by the same, present writ petition is filed.
Heard both sides.
Since the 4th respondent has already issued notices to conduct survey, it is for the 4th respondent to take further action in the matter. In view of the same, the writ petition is
disposed of directing 4th respondent to conduct survey and take action accordingly. No order as to costs. As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
