THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.1200 OF 2018 ORDER:
Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for respondent No.1-State and perused the record.
This petition is filed under Section 482 Cr.P.C. to quash FIR No.24 of 2018, Penamaluru Police Station, Vijayawada City, registered for the offences punishable under Sections 420 and 506 IPC.
During the course of submissions, it has come to light that the petitioner/accused is the Managing Partner of the Company, viz., Evega Solutions. Around five employees were not paid salaries by the Evaga Solutions Company. When they approached, it is alleged that the petitioner/accused threatened and did not pay the salaries.
Learned counsel for the petitioner/accused would submit that now the company is ready to pay the salaries due to its employees, i.e., de facto complainant and others subject to their returning the cheques given by the company and other related documents.
Under these circumstances, the Station House Officer concerned is directed to follow the provisions under Section 41-A of Cr.P.C. and abide by the directions issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1.
With the above direction, this Criminal Petition is disposed of.
