HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.4017 of 2015 ORDER:

Alleging inaction on the part of the respondents in returning licensed Pistol bearing No.618445 made in Czechoslovakia, which is val i d upto 09-12-2016, though he made representations before respondents, the petitioner filed the present writ petition. Learned Government Pleader has received instructions from the 3rd respondent, wherein it is stated that the 3rd respondent called upon the petitioner to deposit the licenced weapon with the police station and accordingly, the petitioner is stated to have deposited the said Weapon on 11-03-2014 with the 3rd respondent. After deposit of the said weapon, the petitioner's whereabouts are not known, as he is stated to have involved in 13 different crimes. It is also stated that the petitioner is presently lodged in Rajamundry Central Prison in connection with P.D.Act vide R.O.C.No.

C2/2674/14, dated 03-062014. The 3rd respondent further stated that though the representation of the petitioner was received, he did not approach the 3rd respondent Police Station. In the meanwhile, the 3rd respondent deposited the weapon with the 1st respondent for safe custody. It is further stated that request of the petitioner was also brought to the notice of the 2nd respondent and the orders of the 2nd respondent are awaited. Evidently, the petitioner's representation is pending with the 2nd respondent under Ex.P-5, dated 23-01-2015. Hence, I deem it appropriate to dispose of the writ petition by directing the 2nd respondent to consider the petitioner's aforesaid representation and pass appropriate orders thereon expeditiously preferably within four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
