THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.32870 of 2013 ORDER:

The petitioner herein is aggrieved by the order passed by the 2nd respondent herein in F.No.89-480/2013 Appeal, dated 0711-2013, though confirming the orders passed by the 3rd respondent herein vide proceeding No.APS00021/B.ED./AP/ 201314/52171, dated 07-06-2013 withdrawing the recognition of the petitioner college w.e.f. 2013-14.

When the matter is called today, an order passed by this Court in W.P.No.14005 of 2015, dated 01-06-2015 is placed on record by the learned counsel for the petitioner and requested this Court to pass the same order and the same is not denied by the learned Standing Counsel for N.C.T.E.

In view of the above and for the reasons recorded therein, the following order is passed:

It is not in dispute that the new regulations framed have come into force on 28.11.2014 and in terms of the aforesaid directions of the Hon'ble Supreme Court, the 3rd respondent has to consider the pending applications as per the new regulations. Since the impugned order, dated 07-11-2013, is passed considering the petitioner's request under old regulations, the same is set aside and the matter is relegated to the 3rd respondent to examine the petitioner's request in terms of new regulations and

to pass appropriate orders.

The Writ Petition is disposed of accordingly. The miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
