ORDER
This writ petition under Section 226 of the Constitution of India is filed to declare the inaction of the 3rd respondent in investigating the matter and filing the charge sheet in Cr.No.132 of 2010 of Nagarampalem Police Station, Guntur District, registered for the offences punishable under Sections 420, 406, 427 read with Section 34 IPC, against the 4th and 5th respondents. 2.
The petitioner herein filed a private complaint before the Special Mobile Magistrate's Court, Guntur, for the offences punishable under Sections 420, 406, 427 read with Section 34 IPC and the same was referred to the police by the Magistrate by exercising power under Section 156(3) of Cr.P.C., and on reference, the 3rd respondent registered the above crime for the said offences. 3.
Though the counsel for the petitioner raised several grounds in the writ petition, learned Government Pleader for Home informed this Court that a final report was already filed before the Special Mobile Magistrate, Guntur, referring the case as civil in nature. 4.
In view of the aforesaid representation made by the learned Government Pleader for Home, the Writ Petition is dismissed as infructuous. No order as to costs.
