HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No.16347 of 2016 ORDER:

Vide present Criminal Petition, the petitioner/Accused No.1 seeks a direction thereby to enlarge him on bail in connection with Crime No. 216 of 2016 registered on the file of Station House Officer, Police Station, Ravulapalem, E.G. District, for the offences punishable under Sections 8 (c) read with Section 20(b)(ii)(c) of NDPS Act. Learned Additional Public Prosecutor appearing on behalf of the respondent-State submits that 784 Kgs of Ganja was recovered from the possession of the petitioner and his associates while transporting the same. Moreover, the petitioner is involved earlier in the very same offence and after releasing on bail, he has again started Ganja business, against which present crime is registered and therefore he is not entitled for bail.

Keeping in view the fact that earlier the petitioner was found involved in the transportation of Ganja and after releasing on bail, he has again committed the very same offence, I am not inclined to grant bail inasmuch as if he is released on bail, he will commit the same offence.

The Criminal Petition is dismissed.
