THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.3280 of 2012 ORDER:

Neither is Sri P. Suresh, learned counsel for the petitioners, present nor is there any representation on his behalf. The relief sought for in this Writ Petition is for a mandamus to declare the inaction of the respondent in not releasing the amount pertaining to the fixed deposit of Rs.3,56,050/- dated 27.8.2004, which expired on 27.8.2007, with interest as illegal, arbitrary and contrary to law. A consequential direction was sought to the respondent to release the amount with accrued interest.

This Court, by its order in WPMP No.4105 of 2012 dated 19.3.2012, directed the respondent-bank to consider the petitioners' representation dated 27.1.2012 forthwith; and communicate the decision taken by them to the petitioners within seven days from the date of receipt of the order.

The reasons why the respondent-bank had failed to return the fixed deposit, even after its term had expired, is not known. As this Court had earlier directed the respondent to consider the petitioners' representation, and to communicate its decision, it is always open to the petitioners, in case they are aggrieved by any such decision of the bank, to question the said decision in appropriate legal proceedings. The interim order passed earlier shall be the final order in the Writ Petition. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, pending, if any, shall also stand closed. There shall be no order as to costs.
